Under the Equality Act 2010, cancer is a protected characteristic from the point of diagnosis — meaning you are protected from workplace discrimination from the day you are diagnosed, regardless of whether your condition is currently affecting your ability to work. This has important implications for employer documentation requests:

  • Employers are legally required to make reasonable adjustments for employees with cancer
  • Dismissal related to a cancer diagnosis may constitute automatic disability discrimination
