Interpretation and Definitions
Interpretation
The words of which the initial letter is capitalised have meanings defined under the following conditions.
The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.
Definitions
For the purposes of this Disclaimer:
- Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Disclaimer) refers to Nobel Medical LLC, 131 Continental Drive, Suite 305, Newark, Delaware 19713, United States, which operates the MedicalCert service.
- Consultation means the paid service You purchase through the Website, under which a Doctor reviews the information You submit and decides whether documentation is clinically appropriate.
- Doctor means a medical practitioner registered with the General Medical Council who reviews consultations submitted through the Service.
- Service refers to the Website.
- You means the individual accessing the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
- Website refers to MedicalCert, accessible from https://medicalcert.co.uk/
What This Disclaimer Covers
This Disclaimer applies to the general information published on the Service. It is not a term of the Consultation and it does not cut the Consultation down.
The Consultation is a paid service. It is governed by our Terms and Conditions, by the professional duties the reviewing Doctor owes You as a GMC-registered practitioner, and by the statutory rights set out in the next section. Nothing on this page limits any of those.
Liability That Cannot Be Excluded
Some liability cannot lawfully be excluded or limited, and nothing in this Disclaimer attempts to exclude or limit any of it. In particular:
- We do not exclude or limit liability for death or personal injury resulting from negligence. Section 65 of the Consumer Rights Act 2015 bars that in consumer contracts and in consumer notices, and section 2(1) of the Unfair Contract Terms Act 1977 bars it more generally.
- We do not exclude or limit liability for fraud or fraudulent misrepresentation.
- Where You are a consumer, we do not exclude or limit our liability to perform the Consultation with reasonable care and skill. That term is treated as included in every contract to supply a service by section 49 of the Consumer Rights Act 2015, and section 57 of that Act prevents it being excluded, or limited so as to stop You recovering the price You paid.
- We do not exclude or limit any other liability that cannot lawfully be excluded or limited.
Your statutory rights as a consumer are not affected by anything on this page.

The information published on the Service is for general information purposes only.
The Company reserves the right to make additions, deletions, or modifications to the contents of the Service at any time without prior notice.
Subject to the section “Liability That Cannot Be Excluded” above, the Company is not liable for indirect or consequential loss arising from Your use of the general information published on the Service.
The Company does not warrant that the Service is free of viruses or other harmful components.
No Medical Advice
The content published on the Service is general health information. It is not medical advice, it is not a diagnosis, and it is not a substitute for consultation with your GP, NHS 111, or another qualified healthcare professional who can assess you directly.
Never disregard professional medical advice, or delay seeking it, because of something you have read on the Service. If you believe you are experiencing a medical emergency, call 999 immediately.
Documents issued through the Consultation are produced by GMC-registered doctors following a clinical review of the information you submit. That review is limited to the information provided and does not constitute ongoing clinical care.
Scope and Limitations of Certificates
Certificates issued through the Service are private medical documents. They are not NHS documents and are not issued on behalf of the NHS.
A private certificate is not a fit note (Med3). Fit notes are the form of medical evidence used in claims for Employment and Support Allowance and certain other state benefits. Under the Social Security (Medical Evidence) and Statutory Sick Pay (Medical Evidence) (Amendment) Regulations 2022, a fit note may be issued by a doctor, a registered nurse, an occupational therapist, a pharmacist independent prescriber or a physiotherapist, and most people obtain one through the NHS. If you need evidence for a benefit claim, obtain a fit note rather than a private certificate.
Acceptance of a private certificate is at the discretion of the recipient. Most UK employers, universities, airlines, and insurers accept documentation from a GMC-registered doctor, but the Company cannot guarantee that any particular organisation will accept a given document. Where a recipient publishes its own evidence requirements, check those requirements before purchasing.
No Legal Advice
References on the Service to legislation, government guidance, or the guidance of bodies such as ACAS are provided for general information only and do not constitute legal advice. Law and guidance change. For advice on your own circumstances, consult a qualified solicitor or an appropriate advisory service.

The Service may contain links to external websites that are not provided or maintained by, or in any way affiliated with, the Company.
Please note that the Company does not guarantee the accuracy, relevance, timeliness, or completeness of any information on these external websites.
Errors and Omissions Disclaimer
The information given by the Service is for general guidance on matters of interest only. Even if the Company takes every precaution to ensure that the content of the Service is both current and accurate, errors can occur. Fair Dealing Disclaimer
The Service may quote copyrighted material which has not always been specifically authorised by the copyright owner. Such material is quoted for the purposes of criticism, review, quotation or reporting current events, with a sufficient acknowledgement of the source.
The Company believes this constitutes fair dealing under section 30 of the Copyright, Designs and Patents Act 1988.
If You wish to use copyrighted material from the Service for your own purposes that go beyond fair dealing, You must obtain permission from the copyright owner.
Views Expressed Disclaimer
Health and legal information published on the Service is prepared and reviewed under the responsibility of our Medical Director, and represents the Company’s position at the date shown on the page.
Where the Service quotes or summarises the views of a third party, those views are the third party’s own and do not necessarily reflect the position of the Company, of any other author, or of any agency, organisation or employer referred to.
No Responsibility Disclaimer
The information on the Service is provided with the understanding that the Company is not herein engaged in rendering legal, accounting, tax, or other professional advice and services. As such, it should not be used as a substitute for consultation with professional accounting, tax, legal or other competent advisers.
